KIOS COE MOBILE APPLICATION PRIVACY NOTICE

 

This privacy notice explains what data is collected when you use the KIOS CoE Mobile Application, how that data is used, and your rights under data protection law. 

To ensure that this privacy notice can be understood by all users, we have made every effort to make it simple and as non-technical as possible. The KIOS CoE Mobile Application (the “App”) has been developed by the KIOS Research and Innovation Centre of Excellence, University of Cyprus (the “KIOS CoE”).

 

1. Who has provided you with the App and who is involved in Data Management?

This app has been developed by the KIOS CoE that is responsible for the processing of personal data collected by the App during the use of the data crowdsourcing feature of the App.

 

2. Is using the App voluntary? 

Using the App is entirely voluntary. It is your decision alone whether and how you use the App. Although installing and using the App is voluntary, if you wish to use the crowdsourcing feature you still have to grant the KIOS CoE your consent to let the App upload the data you collected to its servers. You do this by tapping on the “I AGREE” button, the first time you use the crowdsourcing feature on your phone. Your consent is necessary because otherwise the App will not be able to upload the data you collected. You can, however, select whether you want to upload the collected data or discard them by the end of the collection process.

 

3. On what legal basis is your data processed? 

In principle, the KIOS CoE will process your personal data only on the basis of your consent granted pursuant to Article 6(1) Sentence 1(a) and Article 9(2)(a) of the General Data Protection Regulation (GDPR). If you have granted your consent, you can withdraw it at any time. Further information on your right of withdrawal and instructions on how to exercise this right can be found under Paragraph 10 of this notice. 

 

4. Who is the App aimed at? 

The App is aimed at people who are resident in Cyprus and are at least 18 years old. 

 

5. What personal data is processed? 

The App collects the personal data necessary for the creation of an account (Name, Surname, Email). If using the crowdsourcing feature, the App will also collect data from various sensors on the device, like location, pressure etc. The collected data depend on the individual data crowdsourcing module selected by the user. Data collected and shared from users, are stored to the App backend, maintained and managed by the KIOS CoE. The data processed by the App can be grouped into the following categories: 

5a. Local Sensor Data

Sensor data are generated when you use the “Crowdsourcing” feature, and you collect data. For each sensor sample retrieved, the username, date and time of retrieval (time stamp) are recorded and saved locally in a csv file on the device.

5b. Shared Sensor Data

Shared Sensor Data are the data the user shared at the end of each data collection, to be uploaded to the KIOS servers. If you are using an account for the collection of the data, you can request data deletion of the shared sensor data at any time, based on the username. If you are using the application as a guest user, then there is no option for deletion of the shared data, because guest users are anonymous. 

 

6. App features

6a. Using the App to get informed about KIOS CoE news 

One of the App’s basic functionalities is to inform the users about the latest news of the centre. The users have the opportunity to view the newsfeed, various events, video uploads and the open positions offered by KIOS CoE at the current time. 

6b. Using the App for crowdsourcing 

Another functionality of the App is the crowdsourcing feature. That feature can be used by anyone who wants to actively contribute in the process of collecting scientific data from the smartphone’s sensors or answering surveys to help in different research projects running at KIOS CoE (Crowdsourcing). In order to use this feature, the user must first agree to the consent form about data processing. The users have the option to trim some of the collected data at the beginning or at the end of the collection period, or discard all the collected data in order to protect their location privacy. The collected dataset selected to be uploaded, will be sent to the KIOS CoE servers to be used for research purposes. 

 

7. What permissions and functionality does the App require? 

The App does not require any special access for the basic functionality, but in order to use the crowdsourcing feature, background location and storage permissions are needed to be granted. For some crowdsourcing modules, more permissions may be needed based on the data to be collected. Permissions are programmed differently by different manufacturers. Please note that if the App is denied access, you will not be able to use the crowdsourcing features correctly. 

The App requires an internet connection to load the latest KIOS news, events, videos and the open positions. Internet connection is also needed to upload the collected data to the KIOS Server.

 

8. Who will receive your data? 

The data shared from the users, will be visible to the KIOS researchers in order to be used for research purposes. Also, with proper anonymisation those data will be available to the public through the KIOS Open Data Portal. 

 

9. When will data be deleted? 

All data stored in our servers are deleted upon request from the user. If a user uses the App as a guest, then there is no option for the deletion of the data uploaded from him, because the data will be uploaded from an anonymous user with a random ID.  Note however that this will not and cannot delete any Data already shared to researchers or at the KIOS Open Data Portal as we have no way of interfering with data already shared.

 

10. Withdrawal of consent 

You have the right to withdraw any consent you granted the KIOS CoE in the App at any time with effect for the future. Please note that:

1.         This will not affect the lawfulness of any processing occurred before the withdrawal.

2.         This will not affect any Data already shared to the KIOS Researchers and the public following your consent. This is because once you consent to the sharing of these, they are shared to our researchers and to the public via the KIOS Open Data Portal with the proper anonymisation.  As such, the withdrawal of your consent will not apply to those Data already shared but only apply for those Data not already shared.

 

To withdraw consent related to the Data Processing:

           Navigate to the “Main Menu” of the KIOS CoE App and click on “Withdraw Consent”;  after the User's confirmation, the Crowdsourcing feature of the App will not be accessible to the user.

 

To request deletion of the data uploaded to our servers that are not yet shared to researchers or the public:

           You can go to “Main Menu” on the KIOS CoE App and then click on “Delete my data”, to have your data removed immediately from our servers. Note however that as mentioned above this will not and cannot affect any Data already shared to researchers and the public as we have no way of interfering with data already shared.


 

 

TERMS AND CONDITIONS

 

1. Terms of use

By downloading, browsing, accessing or using KIOS Mobile App, you agree to be bound by these Terms and Conditions of Use. We reserve the right to amend these terms and conditions at any time. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Mobile Application and your use of the services offered on the Mobile Application. Continued use of the Mobile Application will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time.

 

2. Definitions

In these Terms and Conditions of Use, the following capitalised terms shall have the following meanings, except where the context otherwise requires:

"Account" means an account created by a User on the Mobile Application as part of Registration.

"Privacy Policy" means the privacy policy set out in Clause 14 of these Terms and Conditions of Use.

"Register" means to create an Account on the Mobile Application and "Registration" means the act of creating such an Account.

"Services" means all the services provided by KIOS Mobile Application to Users, and "Service" means any one of them.

"Users" means users of the Mobile Application, including you and "User" means any one of them.

 

3. General issues about the mobile application and the services

3.1       Applicability of terms and conditions: The use of any Services and/or the Mobile Application are subject to these Terms and Conditions of Use.

3.2       Location: The Mobile Application and the Services are intended solely for use by Users who access the Mobile Application and make use of the crowdsourcing features.

3.3       Scope: The Mobile Application and the Services are for your non-commercial, personal use only and must not be used for business purposes.

3.4       Prevention on use: We reserve the right to prevent you using the Mobile Application and the Service (or any part of them).

3.5       Equipment and Networks: The provision of the Services and the Mobile Application does not include the provision of a mobile telephone or handheld device or other necessary equipment to access the Mobile Application or the Services. To use the Mobile Application or Services, you will require Internet connectivity and appropriate telecommunication links. You acknowledge that the terms of agreement with your respective mobile network provider ("Mobile Provider") will continue to apply when using the Mobile Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Mobile Application or any such third party charges as may arise. You accept responsibility for any such charges that arise.

 

3.6       Permission to use Mobile Application: If you are not the bill payer for the mobile telephone or handheld device being used to access the Mobile Application, you will be assumed to have received permission from the bill payer for using the Mobile Application.

 

3.7       License to Use Material: By submitting any data, text or images (including photographs) (“Material”) via the Application, you represent that you are the owner of the Material, or have proper authorization from the owner of the Material to use, reproduce and distribute it. You hereby grant us a worldwide, royalty-free, non-exclusive license to use the Material to promote any products or services.

 

4. Location alerts and notifications

4.1       You agree to receive pre-programmed notifications or Location Alerts on the Mobile Application from KIOS CoE on your mobile telephone or other handheld devices (as the case may be).

 

5. Your obligations

5.1       User terms: You agree to (and shall) abide by the terms and conditions of the Kios Mobile App, as may be amended from time to time.

5.2       Accurate information: You warrant that all information provided on Registration and contained as part of your Account is true, complete and accurate and that you will promptly inform us of any changes to such information by updating the information in your Account.

5.3       Content on the Mobile Application and Service: It is your responsibility to ensure that any data, or information available through the Mobile Application or the Services meet your specific requirements.

5.4       Prohibitions in relation to usage of Services or Mobile Application: Without limitation, you undertake not to use or permit anyone else to use the Services or Mobile Application:

5.4.1     to send or receive any material which is not civil or tasteful

5.4.2    to send or receive any material which is threatening, grossly offensive, of an indecent, obscene or menacing character, blasphemous or defamatory of any person, in contempt of court or in breach of confidence, copyright, rights of personality, publicity or privacy or any other third party rights;

5.4.3    to send or receive any material for which you have not obtained all necessary licences and/or approvals (from us or third parties); or which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party in any country in the world;

5.4.4    to send or receive any material which is technically harmful (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data);

5.4.5    to cause annoyance, inconvenience or needless anxiety;

5.4.6    to intercept or attempt to intercept any communications transmitted by way of a telecommunications system;

5.4.7    for a purpose other than which we have designed them or intended them to be used;

5.4.8    for any fraudulent purpose;

5.4.9    other than in conformance with accepted Internet practices and practices of any connected networks;

5.4.10  in any way which is calculated to incite hatred against any ethnic, religious or any other minority or is otherwise calculated to adversely affect any individual, group or entity; or

5.4.11  in such a way as to, or commit any act that would or does, impose an unreasonable or disproportionately large load on our infrastructure.

5.5       Prohibitions in relation to usage of Services, Mobile Application: Without limitation, you further undertake not to or permit anyone else to:

5.5.1    resell any data;

5.5.2    furnish false data including false names, addresses and contact details;

5.5.3    attempt to circumvent our security or network including to access data not intended for you, log into a server or account you are not expressly authorised to access, or probe the security of other networks (such as running a port scan);

5.5.4    execute any form of network monitoring which will intercept data not intended for you;

5.5.5    extract data from or hack into the Mobile Application;

5.5.6    use the Services or Mobile Application in breach of these Terms and Conditions of Use;

5.5.7    engage in any unlawful activity in connection with the use of the Mobile Application or the Services; or

5.5.8    engage in any conduct which, in our exclusive reasonable opinion, restricts or inhibits any other customer from properly using or enjoying the Mobile Application or Services.

 

6. Rules about use of the service and the mobile application

6.1       We will use reasonable endeavours to correct any errors or omissions as soon as practicable after being notified of them. However, we do not guarantee that the Services or the Mobile Application will be free of faults, and we do not accept liability for any such faults, errors or omissions. In the event of any such error, fault or omission, you should report it by contacting us.

6.2       We do not warrant that your use of the Services or the Mobile Application will be uninterrupted and we do not warrant that any information (or messages) transmitted via the Services or the Mobile Application will be transmitted accurately, reliably, in a timely manner or at all. Notwithstanding that we will try to allow uninterrupted access to the Services and the Mobile Application, access to the Services and the Mobile Application may be suspended, restricted or terminated at any time.

6.3       We do not give any warranty that the Services and the Mobile Application are free from viruses or anything else which may have a harmful effect on any technology.

6.4       We reserve the right to change, modify, substitute, suspend or remove without notice any information or Services on the Mobile Application from time to time. Your access to the Mobile Application and/or the Services may also be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore such access as soon as we reasonably can. For the avoidance of doubt, we reserve the right to withdraw any information or Services from the Mobile Application at any time.

6.5       We reserve the right to block access to and/or to edit or remove any material which in our reasonable opinion may give rise to a breach of these Terms and Conditions of Use.
